These Terms & Conditions apply to mindfulbarbell.com, operated by American Riviera Fitness LLC d.b.a. Mindful Barbell (“Mindful Barbell,” “we,” “us,” or “our”). Please read them before using the website. If you do not agree to these terms, do not use the website. Specific bookings and purchases also require the disclosures and agreement presented in the booking or purchase process.

Website purpose and eligibility

The website provides information about our fitness coaching and general wellness education and allows you to submit an inquiry. Services are offered to local Arizona adults over age 30. Our marketing primarily addresses adults over age 50. Website content is educational; it is not licensed healthcare or individualized medical advice. Please read our Disclaimer and Privacy Policy.

Inquiries and Square bookings

Submitting a website inquiry does not confirm an appointment or establish a coaching relationship. All appointment selection, bookings, purchases, and client accounts are handled through Square. Services begin after booking or enrollment is confirmed and required intake and consent steps are completed. Square’s applicable terms and privacy notices govern use of its platform; Mindful Barbell’s service policies govern the services you purchase from us.

Prices and payments

Review the service description, price, any applicable taxes or fees, and purchase terms before completing a transaction through Square. Mindful Barbell does not automatically renew purchases or charge recurring subscription payments. A new website price does not by itself change an existing purchase agreement.

Cancellations and missed appointments

Cancel or reschedule at least 24 hours before your appointment. A cancellation with less than 24 hours’ notice or a no-show is charged at the full cost of the scheduled session. Use the cancellation or rescheduling option associated with your Square booking, or contact [email protected]. Any payment authorization needed to collect a charge is obtained through the applicable booking or service process.

Prepaid sessions and packages

Prepaid sessions and packages are nonrefundable and expire 12 months from the date of the original purchase. Unused sessions expire at that time. These provisions apply subject to any refund, expiration, or other rights that cannot be limited under applicable law. They do not eliminate remedies available if Mindful Barbell fails to provide a purchased service.

Separate client agreements

Client intake, participation consent, and any other service-specific agreement are separate from these website terms. A separately accepted service agreement controls the services it covers if it conflicts with these terms, subject to applicable law. These website terms do not serve as a physical-activity liability waiver.

Additional Website Terms

Permitted use

Use the website lawfully and provide accurate information when contacting us. Do not impersonate another person, send abusive or unlawful content, introduce malicious software, seek unauthorized access, or interfere with the website or other visitors’ use.

Website content

Unless otherwise indicated, website text, photographs, graphics, videos, logos, and resources belong to Mindful Barbell or its licensors. You may view and use them for personal, noncommercial purposes. Other copying, modification, distribution, or commercial use requires permission unless allowed by law. Do not remove ownership notices.

Email and text messages

An inquiry permits us to respond to your request through appropriate channels; it does not enroll you in ongoing marketing emails or texts. Marketing email subscriptions are optional. Square marketing texts use a separate opt-in and are not a condition of purchase. Message frequency varies and message and data rates may apply. Reply STOP to opt out of the relevant text program. For assistance, email [email protected]. Appointment reminders are distinct from marketing, and opt-out choices may affect which reminders you receive.

Third party features

External booking links and embedded maps, videos, and chat may be operated by other providers under their own terms and policies. We do not control those providers’ websites or guarantee their availability. This does not exclude our own responsibilities under applicable law.

Accuracy and availability

We aim to keep information current, but errors or interruptions may occur. Contact us to confirm details important to a purchase. To the extent permitted by law, the website and general informational content are provided “as is” and “as available,” without warranties of uninterrupted availability or fitness for a particular purpose. This does not override express promises in a service agreement or rights that cannot lawfully be excluded.

Limits on liability

To the extent permitted by law, Mindful Barbell is not liable for indirect or consequential losses arising from use of, or inability to use, this website or its general informational content. Nothing excludes liability that cannot lawfully be excluded. These terms do not waive claims relating to in-person services or replace a separately executed participation agreement.

Changes and applicable law

Updates display a new effective date and apply prospectively, with additional notice or renewed agreement where required. They do not retroactively change a completed purchase. Arizona law governs to the extent permitted by applicable law, without removing consumer protections that cannot be waived. These terms do not require arbitration. If a provision is unenforceable, the remaining provisions apply to the extent permitted by law.
