American Riviera Fitness LLC d.b.a. Mindful Barbell (“Mindful Barbell,” “we,” “us,” or “our”) operates mindfulbarbell.com. This policy explains how we handle information from our website, inquiries, and related communications, and how those practices relate to our booking and client-intake processes.

Information you provide

Our website inquiry forms request your name, email address, and phone number. If you communicate with us by email, phone, text, or website chat, we also receive the information you choose to include in that communication. Please do not submit medical records, health history, or other sensitive health information through website forms or chat.

Website hosting and lead management

Kajabi hosts our website and stores inquiry information and email subscription preferences. We use Kajabi to send marketing emails to people who choose to subscribe. Jon Speakman handles website inquiries. Providers supporting the website and communications process information as needed to deliver their services.

Appointments and payments through Square

Appointments, purchases, and client accounts are handled through links to Square, not through an account or checkout on mindfulbarbell.com. Square processes the information you submit through its services under its applicable terms and privacy notices. Mindful Barbell receives booking, customer, and transaction information needed to provide and administer your services. Square’s notices do not replace our responsibilities for information we receive and use.

Health intake outside the website

We do not request health history or assessment results through website forms. Client health intake uses a separate fillable PDF, which may be printed and delivered in person or returned to Mindful Barbell by email. We use that information for fitness intake and coaching. Email is not guaranteed to be secure; you may return the form in person instead. This website policy does not describe every detail of our separate client-record practices.

How we use information

We use contact information to respond to inquiries, discuss service interests, coordinate appointments, and provide requested assistance. We may follow up about your inquiry by phone, email, or text, consistent with applicable law and your communication preferences. We also use information to maintain business records, administer services, protect our systems, and satisfy legal obligations.

Marketing choices

Ongoing marketing emails are optional and use a separate opt-in. You can unsubscribe through a marketing email or contact [email protected]. Mindful Barbell sends limited marketing texts and appointment reminders through Square. Marketing texts require a separate opt-in; submitting a website inquiry does not enroll you. You can reply STOP to opt out of the relevant Square text program or contact us for help. Service communications may continue through another appropriate channel when needed.

Cookies and Privacy Choices

Cookies and embedded features

Kajabi and embedded features may use cookies and similar technologies to operate the site, support functionality, and measure use. Technical information can include an IP address, browser or device information, pages viewed, and interactions with site features. Embedded maps, coaching videos, and chat may transmit technical information to their providers when loaded or used. Chat also processes messages you submit. Providers may associate this information with their own cookies or accounts and may collect activity across websites under their own policies.

Mindful Barbell does not install advertising pixels or retargeting tools and does not use software to record visitors’ browsing sessions. These practices do not prevent an embedded provider from collecting information as described above. You can manage cookies in your browser, although blocking them may affect some features.

The website includes “Get Direction” links in the footer that direct visitors to Google Maps. The Home page features four client testimonial videos hosted through Kajabi. Do Not Track (DNT)

Some browsers offer a Do Not Track (DNT) setting that communicates a user's preference regarding online tracking. Because DNT is deprecated and is not consistently supported across browsers, our website does not rely on DNT signals as its primary method of managing cookie consent. We do not sell, rent, or trade customer or lead information, or provide it to other businesses for their independent marketing. We use providers such as Kajabi, Square, email services, and embedded-feature providers to operate our business and website. Those providers process information needed for their functions. We may also disclose information when legally required or when reasonably necessary to protect rights or safety. Mobile opt-in and consent information is not shared for another company’s marketing; providers may process it to deliver our messages.

Retention

We review lead records annually and delete inactive, non-client inquiry records with no interaction for at least 24 months. Because reviews are annual, deletion may occur at the next review after that period. We retain current marketing subscriptions until you unsubscribe or request deletion, subject to applicable law. We may retain limited records to honor opt-outs and records needed for legal obligations, disputes, or client services. The inquiry schedule does not govern transaction or health-intake records.

Requests and security

Contact [email protected] to request access, correction, or deletion, or to ask about our practices. We may verify your identity and retain information where legally permitted or required. We handle applicable privacy rights under the law that governs the request. No online service, email transmission, or storage system is guaranteed completely secure.

Adults and policy updates

Our services are for adults over age 30, and the website is not directed to children. We do not knowingly collect information from children under 13. Contact us if you believe a child has provided information. We will update this policy as practices change and revise its effective date, with additional notice or consent where required.
